What types of intellectual property can be registered and protected in Egypt?
Egypt’s Intellectual Property Law (Law No. 82 of 2002) provides comprehensive protection for a wide range of IP assets. Registrable IP rights include patents, utility models, trademarks, industrial designs, layout designs of integrated circuits, and plant varieties. Copyright and undisclosed information (trade secrets) are also protected under the law, though they do not require registration to establish rights. Patent applications are filed with the Egyptian Patent Office, which was the first in the African, Arab, and Middle Eastern regions to be designated as an International Searching Authority. The process involves filing, formal examination, substantive examination, and grant. In October 2025, the Egyptian Intellectual Property Authority (EGIPA) issued Decree No. 138 of 2025, introducing significant fee increases — for example, search fees increased from EGP 2,000 to EGP 7,000 (a 250% increase), and filing fees rose from EGP 50 to EGP 200. New services fees were also introduced, including assignment (EGP 10,000) and licensing (EGP 10,000). Trademark owners have several enforcement mechanisms under Egyptian law. Ownership is established by “first use of the mark” in the market, though registration is necessary for enforcement and serves as proof of ownership. Registered owners can: (1) oppose the registration of identical or similar trademarks; (2) initiate raids against traders of counterfeit products; (3) file trademark imitation misdemeanor charges; and (4) seek compensation for damages and lost profits. Well-known trademarks enjoy even broader protection, with the status determined at the court’s discretion. Copyright in Egypt is automatically protected upon first publication or prior submission, without requiring registration. However, registration provides critical evidentiary benefits. Copyrightable works include books, scripts, software code, drawings, cartoon characters, and creative shapes — each registered with the relevant sector (e.g., software codes with the National Library, artistic works with the Fine Arts Sector at the Supreme Council of Culture). Recent EGIPA fee updates (Decree No. 141 of 2025) increased filing fees from EGP 200 to EGP 1,000, among other changes.
